Terms of Service

These Terms govern your use of the RaceClub mobile application (“RaceClub”, “the app”). By using RaceClub, you accept these Terms.

1. The service

RaceClub is an iOS application for tracking sailing races via GPS. It offers:

To use RaceClub you must be at least 13 years old. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for any activity on your account.

RaceClub is an auxiliary tool for sport tracking. It is NOT a navigational aid.

You remain solely responsible for your safety on the water:

RaceClub may stop working at any time (battery, GPS loss, network, software issues). The developer accepts no liability for any incident, injury, loss or damage resulting from reliance on the app.

5. Your content

You retain ownership of the data you create (boats, races, GPS tracks). By using Club Races, you grant other participants of the same race the right to see your real-time position for the duration of the race.

You grant Arthur Queval a limited license to host, store and process this data solely for the purpose of operating the service.

6. Intellectual property

The RaceClub app, its name, design, code and trademarks are the property of Arthur Queval. You receive a limited, personal, non-transferable license to use the app for its intended purpose.

7. Termination

You may delete your account at any time by emailing a.queval@gmail.com.

We may suspend or terminate your access if you violate these Terms or if continued operation becomes impractical (technical, legal or commercial reasons), with reasonable notice when possible.

8. Limitation of liability

To the maximum extent permitted by law, Arthur Queval shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the app. Total liability, if any, is limited to the amount you have paid for the app over the last 12 months (CHF 0 for the pilot phase).

This limitation does not apply to liability that cannot be excluded by applicable law (e.g. gross negligence, willful misconduct).

9. Changes

We may update these Terms. The “Last updated” date reflects the latest version. Material changes will be notified in the app. Continued use after notification constitutes acceptance.

10. Governing law

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Geneva, Switzerland, subject to mandatory consumer protection rules of the user’s country of residence.
